Terms and Conditions of Service

All quotations, itinerary proposals, bookings, and travel arrangements made by or through GosRaha Journeys (the “Company”, “GosRaha”, “we”, “us”, or “our”) are subject to these Terms & Conditions of Service (the “Terms”).

GosRaha curates, organises, and arranges bespoke travel experiences and may book, coordinate, reserve, or facilitate travel services provided by independent Third-Party Suppliers, including but not limited to airlines, accommodation providers, transfer operators, guides, activity providers, permit issuers, restaurants, and other travel-related service providers.

These Terms form the basis of the contract between GosRaha and the Client making the booking (“you”, “your”, or the “Client”). By requesting detailed itinerary work, paying the Curation Fee, accepting a quotation, making any booking payment, or confirming a booking, you agree to be bound by these Terms on your own behalf and, where applicable, on behalf of all travellers included in your booking.
 

1. Definitions

a. “Booking” means the travel arrangements, itinerary, and related services requested by the Client and arranged or to be arranged by GosRaha.

b. “Booking Confirmation” means the point at which the Client accepts the quoted itinerary and pays the required booking deposit or other required sum stated by GosRaha.

c. “Curation Fee” means the non-refundable fee charged by GosRaha for detailed itinerary design, supplier research, proposal development, and bespoke travel curation work beyond an initial enquiry stage.

d. “Departure Date” means the first date on which any booked travel service is scheduled to commence.

e. “Lead Traveller” means the person making the booking on behalf of the other travellers in the booking.

f. “Third-Party Supplier” means any independent supplier providing any travel-related product or service forming part of or connected with the Booking.

g. “Travel Services” means accommodation, transport, flights, transfers, tours, activities, permits, guiding, dining reservations, and any other travel-related services arranged by GosRaha.
 

2. Authority of the Lead Traveller

a. The Lead Traveller warrants that he or she has full authority to make the booking on behalf of all travellers included in the Booking and to bind them to these Terms and any applicable Third-Party Supplier terms.

b. All communications, consents, acknowledgements, notices, invoices, refunds, credits, and documents provided to or received from the Lead Traveller shall be deemed to have been provided to or received from all travellers in the Booking.

c. The Lead Traveller is responsible for ensuring that all travellers receive and understand the relevant booking documents, travel information, and requirements.
 

3. Curation Fee and Detailed Itinerary Stage

a. An initial enquiry or introductory discussion does not automatically attract the Curation Fee.

b. Once you request a more detailed bespoke itinerary, supplier research, proposal development, or substantive curation work beyond an initial exploratory enquiry, GosRaha may require payment of a Curation Fee of USD 300 before commencing such work.

c. The Curation Fee is earned upon commencement of the relevant curation work and is non-refundable, save where GosRaha expressly agrees otherwise in writing.

d. Payment of the Curation Fee does not by itself confirm any booking, reserve any service, or guarantee the availability of any quoted travel service.

4. Booking Deposits, Confirmation, and Final Balance

a. To confirm a Booking, the Client must pay the booking deposit stated in the quotation. Unless otherwise stated, the booking deposit shall be 50% of the quoted total price less any Curation Fee already paid.

b. Certain Travel Services may require different or additional payment terms, including full prepayment for flights, peak-season services, specialist products, permits, or supplier-specific deposits.

c. Booking Confirmation occurs only when GosRaha has received the required payment and has confirmed acceptance of the Booking in writing.

d. The outstanding balance is due not less than sixty (60) days before the Departure Date unless a different deadline is stated in writing.

e. If a Booking is made less than sixty (60) days before departure, the full Booking price may be payable immediately.

f. Failure to make any required payment by the due date may result in suspension or cancellation of the Booking and forfeiture of any non-refundable or irrecoverable sums already committed.

5. Prices, Availability, and Currency

a. All quotations are subject to availability, supplier confirmation, currency fluctuation, revision of taxes, fees, levies, park fees, fuel surcharges, and other supplier-imposed changes until the required payment is received and the relevant services are confirmed.

b. GosRaha may revise the quoted price where there is a material increase in external supplier costs, taxes, tariffs, exchange rates, or other costs outside GosRaha’s reasonable control before final confirmation or ticket issuance, as applicable.

c. Payments shall be made by the payment methods approved by GosRaha. Unless otherwise stated, payments may be processed in USD.

d. Bank charges, card charges, exchange losses, intermediary charges, and transfer costs are for the Client’s account unless GosRaha expressly agrees otherwise in writing.

6. Supplier Terms and Independent Suppliers

a. Many of the Travel Services arranged by GosRaha are provided by independent Third-Party Suppliers.

b. Once the proposed itinerary has been selected and the relevant suppliers are identified, GosRaha will provide, attach, link, summarise, or otherwise make available the material terms and conditions of the applicable Third-Party Suppliers.

c. By confirming the Booking, the Client acknowledges and accepts that the Booking is subject both to these Terms and to the applicable terms and conditions of the relevant Third-Party Suppliers.

d. GosRaha shall not be responsible for any changes, cancellations, restrictions, requirements, conditions, or operational rules imposed by Third-Party Suppliers except to the extent such matters are caused directly by GosRaha’s own conduct.

7. Client Information and Travel Documents

a. The Client is responsible for ensuring that all names, dates of birth, passport information, nationality details, contact details, dietary information, medical disclosures, and any other personal information supplied for the Booking are complete and accurate.

b. GosRaha shall not be liable for losses, delays, denied boarding, denied entry, additional charges, or booking issues arising from inaccurate, incomplete, or late information supplied by the Client.

c. Where required, valid passport copies and any other supporting travel documentation must be supplied by the deadlines communicated by GosRaha.

d. Final travel documents, confirmations, vouchers, and tickets may be withheld until all required payments, documents, and insurance proofs have been received.

8. Changes Requested by the Client

a. If the Client requests changes to a confirmed or proposed Booking, GosRaha will use reasonable efforts to accommodate such changes, but cannot guarantee that changes will be possible.

b. The Client shall be responsible for all costs, supplier charges, fare differences, cancellation fees, reissue fees, and any other expenses arising from requested changes.

c. In addition to any supplier charges, GosRaha may charge a reasonable administration fee for amendments.

9. Involuntary Changes and Availability Issues

a. GosRaha will use reasonable efforts to deliver the confirmed itinerary substantially as booked. However, availability and logistics may change because of supplier decisions, operational requirements, safety considerations, regulatory requirements, or events outside GosRaha’s reasonable control.

b. If a quoted or confirmed service becomes unavailable before departure, GosRaha may offer a reasonable alternative and any resulting price difference shall be adjusted accordingly.

c. If no reasonable alternative is available, or if the Client reasonably declines the alternative offered, GosRaha shall refund any amount paid for the affected service that has not already been irrecoverably committed or rendered non-refundable under applicable supplier terms.

d. Except to the extent caused by GosRaha’s own breach of these Terms, GosRaha’s total liability in respect of any affected service shall not exceed the amount paid to GosRaha for that affected service.

10. Cancellations and Refunds

a. All cancellations by the Client must be made in writing and shall take effect only when received and acknowledged by GosRaha.

b. If the Client cancels a Booking, the Client shall remain liable for the Curation Fee, any non-refundable supplier charges, any irrecoverable sums already committed by GosRaha on the Client’s behalf, and any cancellation charges applicable under supplier terms.

c. Where the Client cancels more than sixty (60) days before departure, the Client will forfeit the Curation Fee and any other non-refundable or irrecoverable sums already committed.

d. Where the Client cancels sixty (60) days or less before departure, the Client may be liable for up to 100% of the total Booking price depending on the timing of cancellation, the relevant supplier terms, and the extent to which sums have become non-refundable or irrecoverable.

e. If GosRaha obtains any refund, waiver, or credit from one or more Third-Party Suppliers, GosRaha may pass that amount on to the Client less any reasonable administration fee, banking charge, exchange loss, or related cost incurred.

f. No refund shall be due for partly used arrangements, unused services, or services missed by the Client except to the extent that GosRaha actually recovers a refund from the relevant supplier.

11. No-shows

a. A no-show includes any failure by the Client or any traveller to arrive in time for accommodation check-in, flight departure, transfer departure, activity commencement, permit collection, or any other booked service where the supplier treats the service as unused, forfeited, or cancelled.

b. No refund shall be due in respect of any no-show, partly used service, or unused voucher except to the extent that GosRaha actually recovers a refund or waiver from the relevant supplier, less any reasonable administration fee and related costs.

c. The Client remains responsible for all additional costs arising from any delay, missed connection, late arrival, or missed service unless caused directly by GosRaha’s own breach.

12. Flights, Baggage, and Special Carrier Rules

a. Flight bookings, tickets, fare rules, changes, cancellations, baggage allowances, seat allocations, meal requests, and related matters are subject to the terms and conditions of the relevant airline or air carrier.

b. Airfares are not guaranteed until full payment has been received and the relevant ticket has been issued.

c. Light aircraft and charter operators may impose special baggage restrictions relating to weight, size, and bag structure. Compliance with such restrictions is the Client’s responsibility.

d. GosRaha shall not be liable for lost, delayed, damaged, or excess baggage except to the extent caused directly by GosRaha’s own breach.

13. Passports, Visas, Inoculations, and Fitness to Travel

a. The Client is solely responsible for ensuring compliance with all passport, visa, entry, transit, vaccination, inoculation, medication, health, and travel documentation requirements applicable to the itinerary.

b. The Client warrants that all travellers are medically fit for the booked journey and for any planned activities, unless any relevant limitation has been disclosed to GosRaha and accepted in writing.

c. The Client must disclose any material medical, mobility, dietary, accessibility, or safety-related information that may affect the Booking or participation in activities.

d. GosRaha shall not be liable for denied entry, missed services, extra costs, or losses arising from the Client’s failure to meet applicable travel or health requirements.

14. Travel Insurance

a. Comprehensive travel insurance suitable for the booked itinerary is a mandatory condition of travel with GosRaha.

b. The Client must provide documentary proof of such insurance within seven (7) days after payment of the final balance and, in any event, not later than thirty (30) days before the Departure Date, whichever is earlier.

c. For any Booking made within thirty (30) days of departure, proof of insurance must be provided within forty-eight (48) hours after Booking Confirmation and before final travel documents are released.

d. The required cover should include, where appropriate to the itinerary, cancellation, curtailment, medical expenses, emergency evacuation, repatriation, personal liability, baggage loss or damage, and cover for any relevant adventure or specialist activities.

e. If the Client fails to provide satisfactory proof of insurance by the required deadline, GosRaha may suspend further performance, withhold final documents, or cancel affected arrangements without liability for any non-refundable supplier charges or irrecoverable sums already incurred.

f. Where GosRaha suggests any insurer, evacuation provider, or related service provider, it does so for convenience only and does not act as insurer, broker, adviser, or guarantor of the adequacy, validity, or suitability of any policy or provider.

15. Excluded Services

a. Unless specifically stated in the confirmed itinerary, the Booking price excludes items such as visas, passport costs, gratuities, excess baggage, personal expenses, laundry, telecommunications, optional activities, beverages not expressly included, and any other items not expressly listed as included.

b. The Client is responsible for all such excluded costs.

16. Special Requests

a. Special requests such as adjacent rooms, connecting rooms, bedding preferences, dietary requirements, or other preferences should be communicated as early as possible.

b. GosRaha will use reasonable efforts to communicate and pursue special requests, but cannot guarantee that any request will be met unless expressly confirmed in writing.

17. Liability, Risk, and Limitation of Claims

a. Travel, including active and wilderness/bush-based travel, may involve inherent risks including illness, injury, delay, weather disruption, wildlife exposure, terrain hazards, remoteness, transport interruptions, and other risks beyond GosRaha’s reasonable control.

b. The Client acknowledges and accepts such inherent risks for all travellers in the Booking.

c. GosRaha shall not be liable for the acts, omissions, defaults, insolvency, delays, cancellations, overbooking, safety failures, or service shortcomings of any independent Third-Party Supplier except to the extent caused directly by GosRaha’s own breach, fraud, wilful misconduct, or gross negligence.

d. To the fullest extent permitted by law, GosRaha shall not be liable for any indirect, incidental, special, punitive, or consequential loss, including loss of enjoyment, loss of opportunity, loss of income, or missed onward connections not directly caused by GosRaha.

e. Subject to applicable law and the carve-outs above, GosRaha’s aggregate liability arising from or in connection with any Booking shall not exceed the amount paid to GosRaha for the affected service or, where the claim concerns the Booking as a whole, the total amount paid to GosRaha for that Booking.

f. Nothing in these Terms excludes or limits liability which cannot lawfully be excluded or limited.

18. Complaints and On-Trip Issues

a. If any issue arises during travel, the Client must notify GosRaha and, where appropriate, the relevant supplier as soon as reasonably possible so that the issue may be investigated and, where possible, remedied during the trip.

b. Any formal complaint must then be submitted in writing to GosRaha within thirty (30) days after the relevant incident or the end of the trip, whichever occurs first.

c. Failure to notify GosRaha promptly during the trip may reduce or defeat any later claim to the extent that the issue could reasonably have been mitigated or addressed at the time.

19. Intellectual Property

a. All itineraries, travel concepts, proposals, written materials, website content, branding, logos, designs, layouts, graphics, and related materials produced by or for GosRaha remain the intellectual property of GosRaha unless expressly agreed otherwise in writing.

b. The Client shall not reproduce, distribute, copy, publish, exploit, or share GosRaha’s itineraries, proposals, or materials for commercial use or for booking around GosRaha without GosRaha’s prior written consent.

20. Confidentiality and Data Protection

a. GosRaha will use reasonable technical and organisational measures to protect personal data and confidential information collected for enquiry handling, itinerary development, booking administration, communications, customer support, compliance, and trip delivery.

b. In order to assess, arrange, confirm, and operate Bookings, GosRaha may share personal data with relevant Third-Party Suppliers and service providers, including accommodation providers, airlines, transfer operators, guides, insurers or evacuation providers where applicable, payment providers, professional advisers, and cloud or communications platforms used for business operations.

c. The Client confirms that the personal data provided for all travellers is accurate and that the Lead Traveller is authorised to provide such data and to receive relevant notices on behalf of the other travellers.

d. Personal data may be processed and stored using cloud-based systems, including Google Workspace or Google Drive, and may be accessed or processed outside Kenya where reasonably necessary for the purposes of providing the Booking or operating GosRaha’s business systems, subject to applicable legal requirements and safeguards.

e. GosRaha may retain personal data only for so long as reasonably necessary for booking administration, legal compliance, dispute handling, record keeping, customer support, and related legitimate business purposes.

f. Any separate privacy policy published by GosRaha forms part of the wider information provided to the Client regarding data processing, but these Terms continue to govern the contractual relationship.

21. Force Majeure

a. GosRaha shall not be liable for failure or delay in performance where such failure or delay is caused by events beyond its reasonable control or beyond the reasonable control of the relevant Third-Party Supplier, including acts of God, war, threat of war, riots, civil unrest, government action, terrorism, border closures, strikes, labour disputes, disasters, epidemics, pandemics, quarantine, weather events, fire, transport disruption, or similar events.

b. If a Force Majeure Event affects the Booking, GosRaha may cancel, postpone, curtail, substitute, reroute, or otherwise amend the affected Travel Services as reasonably required.

c. In such circumstances, the Client remains liable for all non-refundable or irrecoverable supplier charges and any sums already committed on the Client’s behalf.

d. Where GosRaha obtains any refund, credit, waiver, or other recovery from a supplier in connection with a Force Majeure Event, GosRaha may pass that amount on to the Client less any reasonable administration fee, banking charge, exchange loss, or related cost incurred.

22. Dispute Resolution and Governing Law

a. These Terms and any Booking shall be governed by the laws of the Republic of Kenya.

b. If any dispute arises, the parties shall first attempt in good faith to resolve the dispute through direct discussions.

c. If the dispute is not resolved through direct discussions within fourteen (14) days after written notice of the dispute, either party may refer the matter to mediation in Kenya.

d. If the dispute is not resolved through mediation within a reasonable period, either party may commence proceedings in the courts of Kenya.

e. Nothing in this clause prevents either party from seeking urgent interim relief from a court of competent jurisdiction where necessary.

23. General

a. These Terms, together with the applicable quotation, itinerary, booking confirmation, and any expressly incorporated supplier terms, contain the full agreement between the parties relating to the Booking.

b. No amendment, waiver, addition, or cancellation of these Terms shall be binding unless recorded in writing.

c. If any provision of these Terms is found to be invalid or unenforceable, that provision shall be severed to the minimum extent necessary and the remainder shall remain in full force.

d. A failure by either party to enforce any right immediately shall not constitute a waiver of that right.

e. The Client may not assign, transfer, novate, or otherwise dispose of any Booking or any right under these Terms without GosRaha’s prior written consent.

f. GosRaha may assign or transfer its rights or obligations under these Terms as part of a corporate restructure, business sale, or successor arrangement, provided that such assignment does not materially reduce the Client’s rights under the Booking.

g. The version of these Terms in force at the time of Booking Confirmation shall apply to the Booking unless a change is required by law or regulation, in which case GosRaha may issue an updated version to the Client.
